This article discusses common reasons why boats, in fact, sink. Finding out why a particular vessel sank is the first step in determining legal liability. That is, who was at fault and whether legal damages may be recovered in a boat sinking incident.

Dockside Boat Sinkings

Most recreational boat sinkings occur at dockside. In these instances, it is usually much less difficult to discover the cause of the sinking because the vessel can be relatively easily raised and inspected. Because the vessel sank at a dock, absent a fire or an explosion, most dockside vessel sinkings do not result in personal injury or death. There are exceptions, of course, but that has been our experience.

The following are common reasons for boats to sink at dockside:

1. A fitting below the waterline failed.

2. Rain/ snow.

3. A failed fitting above the waterline.

4. Improper docking, such as a boat being caught under a dock with a rising tide.

5. Fires and explosions.

Common Causes of Boat Sinkings While Underway

When a vessel sinks while underway, sometimes it is difficult to determine causation because the vessel is not available for inspection because it is lost. However, in spite of the vessel being lost,it is still possible to determine causation even though the vessel is lost.

The following are common reasons while boats sink while underway:

1. Improper vessel design: Of course, the smaller the boat, the more prone it is to sinking. Improperly designed cockpits are the most common reason powerboats sink.

2. Hull damage due to collisions or striking an object: When a hull's integrity is seriously breached, boats sink.

3. Taking water over the gunwales: Taking water over the gunwales or the transom is a major cause of vessels sinking.

4. Bilge pumps failing: This occurs in power and sail boats. Improper head installation, sink drains, inadequate bilge pumps and battery systems all can cause vessels to sink. Errors in plumbing design, insufficient pumping, insufficient battery capacity, failed hull fittings and failed hoses can also cause boats to sink.

5. Over weighting: A 100 gallon fuel tank holds 700 lbs. of fuel. The fuel can easily change the trim of a 24' boat by at least two inches. When the tank is toward the stern the change may be more. Improper loading with too many passengers or gear also causes vessels to sink.

6. Defective scuppers: Scuppers allow water from decks to drain off. While their purpose is to drain water to the outside, oftentimes they allow water to drain INTO the vessel, thereby flooding the vessel. Cockpit scuppers may allow water to sink the boat. Many experts recommend closing them up and relying on the bilge pumps.

7. Defective plastic hatches: Oftentimes, not only are these not watertight, but they can allow large amounts of water to leak through the allegedly gasket-sealed cover.

8. Open transoms: Most open transom boats are sinkings waiting to happen. With an open transom, a vessel is at huge risk if it loses power. Under these circumstances, the lack of a transom becomes very dangerous. Most boats that are swamped are outboard powered, with engine cut-outs which are a few inches above the water.

9. Improper wiring: Many boats are designed such that shutting off the main power - by the main breaker or battery switches, shuts off the bilge pumps.

10. Outboard motor wells: Motor wells allow water to leak and possibly sink the vessel. Openings for control cables which are not sealed properly allow water to leak.

11. Bellow leaks: The bellows or boots that run between the engine (the "I" in inboard) and the partially submerged outdrive (the "O") degrade or crack and allow water to leak into the vessel.

12. Not inserting a drain plug: Forgetting to put in the drain plug is more common than you might expect.

Where Will I Be Bass Fishing?

First you should ask yourself what size water you will be bass fishing in. If you are fishing small rivers, ponds and lakes, you could easily get by with a smaller boat with a smaller outboard motor. If, on the other hand, you will be fishing a lot of bass tournaments and will often be fishing larger bodies of water, you might consider purchasing a larger boat with bigger outboard motor.

Aluminum or Fiberglass Boat?

The next consideration is what type of bass boat will fit where you are fishing. An aluminum boat is of course much lighter weight and a smaller outboard motor will work nicely if you are fishing smaller bodies of water. An aluminum boat will ride rougher, handle rougher and make more noise in choppy water. For example a 16 foot aluminum bass boat with a 40 hp outboard motor will be a great choice for smaller bodies of water.

A fiberglass bass boat will handle larger, rougher water and give you a much smoother ride but you should consider that you will need a bigger outboard motor to get the performance you need. Be advised that a fiberglass bass boat will be much more expensive because you will have a selection of fancy paint jobs and more options available to you.

Will I Need a Dual Purpose Boat?

The next consideration is whether the boat will be used strictly for fishing or will it be a dual purpose boat for skiing and pleasure riding. If that is a possibility, you may consider a "Fish and Ski" bass boat. Usually this is a fiberglass bass boat that not only has pedestal seats for fishing, but also is designed with rider seats for passengers. This type of bass boat is popular with the bass angler that has a family that enjoys pleasure boating and skiing along with fishing outings.

New or Used Boat?

The next big question is whether to buy a new or used bass boat. Maybe you know someone reliable who is upgrading their boat and has taken great care of the older boat they want to sell which would give you a great opportunity to purchase for a relatively low cost.

The summer has finally arrived. This year, you are excited because you are going to buy your first motorized boat. But before you take off across the river or lake, whether it is for joyriding or fishing, there is a mandatory boating equipment list in the United States. If living in a different country, please check online for changes/additions to the following requirements.

The waterways are supervised by police and they will stop you to do a boat check. Best to be prepared!

Required Documents: Have your boat ownership registration papers and photo identification with you at all times, whenever you go out in a boat.

Life Jackets (Personal Floatation Devices): A life jacket is a jacket or belt that helps a person to float in the water and prevents a person from drowning.

Every person on a boat must wear a life jacket. They have to fit right and be the correct size. Children have got to wear a life jacket at all times. Never put an adult life jacket on a child.

If the boat is 16 feet and longer, then it requires having a minimum of one life-ring or floating cushion. If there is an emergency and someone is at risk of drowning, then the life ring is used.

Fire Extinguisher: All boats that have an engine and/or fuel tank in an enclosed compartment must have a fire extinguisher that does not have an expired date on it. If it has an expired date on it then it might not function properly in an emergency.

Emergency Signals and Noise Making Devices: All boats require functioning distress signals whether it is red flares, distress flags, or orange smoke. A good Horn or whistle is also needed. You can use a hand-held whistle for small boats but the larger boats need a horn that can be heard a good distance away.

Boat Lights: It is very important that the lights on your boat be put on properly according to size and class of your boat. These lights are a signal to other boat operators as to whether your boat is anchored, sailing or motorized.

Green Light- shows directly in front to 112.5 degrees down the right side (known as starboard) of the boat.

Red Light- shows directly in front to 112.5 degrees down the left side (known as port side) of the boat.

White Masthead Light- shows in the whole 225 degrees that is covered by the total area of both of the Green and the Red lights together.

White Stern Light- shows at the back of the boat to 67.5 degrees on both sides of the stern. This gives a total area of 135 degrees..

To avoid really nasty fines from the authorities, ensure that you always do a check of all the required equipment. Before taking off in your boat, make sure that everything is doing what it is suppose to do.

There many different kinds of boat suitable for ones need and one of them can be inflatable boats. These boats are usually very light-weighted and constructed with flexible tubes at the gunwale. They are often designed to be portable by being deflated and packed into a small volume allowing them to be used as life rafts for boats or aircraft or simply so that they can easily be transported to water. Boats may have rubber floors, either plain or inflatable, or they may include steel, wood or aluminum sheets for rigidity. The tubes are made of rubberized, synthetic sheets of Hypalon or PVC to provide light-weight and secure buoyancy. The tubes are often constructed in separate sections, each with a valve to add or remove air, to reduce the effect of a puncture. Should one section puncture it is quite possible to repair it while still underway.

More extensive inflatable boat repairs - due to pinholes, punctures, peeling, leaks or worn fabric - can be done easily and inexpensively in dry dock using new innovative two-stage synthetic rubber coatings (SRC). Some inflatable boats have an inflated keel to create a "groove" along the line of the hull improving the hull's wave cutting and turning performance. Due to the weight, it is very easy to cause an inflatable boat to start hydroplaning, thus making it faster than the engine would allow when the hull is operating in displacement mode. The rigid-hulled inflatable boat is a development of the inflatable boat.

Due to the speed, the portability and the weight, inflatable boats are used extensively in tending operations in port and at sea, recreational water skiing, commercial fishing, and mostly as Rescue crafts. These can be restored or even repaired if they are subjected to a great deal of wear and tear from the elements such as water and sun. As these products aggressively adhere to the damaged Hypalon or PVC shell can fix virtually any surface damage through a unique chemical bonding between the undercoat and topcoat that permanently vulcanizes the two rubber coatings together to make the inflatable as good as new. But as these kind of boats are very cheap they are mostly replaced by a new one.

If you're buying a new boat, dealers often charge a "commissioning" fee to cover the installation of any special equipment, tuning the engine and other post-purchase items. Most boat owners a responsible about budgeting for the initial purchase and outfitting of their boats, but underestimate the ongoing costs, which are the bulk of the costs of owning a boat. Rules Of The Road: How To Determine Who Was At Fault In A Boat Collision

"Rules of the Road," is a term used for regulations that govern the conduct of boats in relation to each other. In other words, in collision situations. The purpose of Rules of the Road is to prevent vessel collisions. Think of navigational rules as a set of rules, much like the "rules of the road" apply to car drivers.

There are two sets of navigation rules: inland and international. International navigation rules are standardized all over the world, allowing boats from different countries to follow the same rules when they meet. Inland navigational rules can vary from region to region. Nautical charts typically include a demarcation line which shows when the Nav rules transition from inland to international, so that boaters can be aware of changing standards of navigation. In general, these demarcation lines follow the coastline and cross inlets and bays. On the seaward side of the demarcation lines, international rules apply.

The COLREGS

Understanding navigational rules or COLREGS (Collision Regulations) and knowing which is the stand-on boat or which is the give-way boat, is essential to determining which boat was the cause of a collision which occur on the navigable waters of the United States.

These are known as the Pennsylvania Rule and Breach of Statute.

Reasonable Care Under the Circumstances

In a collision situation, the Rules of the Road or State navigational rules are the primary method for determining who was at fault for the collision. However, the law also allows for recovery based upon a violation of a duty of care. The law imposes duties upon vessel operators under different circumstances The standard here is whether the acts or omissions which caused the collision were reasonable under the circumstances. In order to prevail under general maritime law you must prove a duty, breach of duty, the breach of duty was a cause of your injuries and damages.

Bass Fishing Tournament Etiquette

Bass fishing in tournaments doesn't seem like a sport in which "proper etiquette" really means much. I've fished many bass tournaments in Florida and found out through experience that it is very important.

Let's look at this bass tournament scenario. You get up early in the morning preparing for your fishing trip. You then drink a couple cups of coffee, light up a cigarette and take care the 3 s's before you hitch up your boat. Once on the road you have a nice conversation with your "draw" partner on where you're going to start and what you're gonna throw so you guys can catch loads of fish in your favorite honey hole.

By the end of the tournament, you weigh in your fish and manage to get 5th place! Lucky for you, the tournament had enough entries to pay all the way to 7th place. You are real happy until a few of the guys give you the "bird" and say some unpleasant things to you. Then you think, "What's their problem?"

It isn't until you partner says he's getting a ride home with someone else and starts taking his tackle out of your boat that you start thinking it maybe something you did.

Let's replay the tournament day.

Early that morning you get up a little late 'cause you forgot to set your alarm clock. Once on the road, you swing by to pick up your partner. He asks why you didn't call him telling him you would be a little late and you respond: "I didn't have time!" You also tell him that your swinging by the gas station and he needs to fill up the boat and truck since you make the boat and insurance payments. You emphasis that it's normal for the "draw" partner to do this.

You finally get to the boat launch area and wait patiently in the line of trucks to launch your boat. You leave your lights on so anyone coming behind you will see you. When you get to the front of the line you and your partner exit the truck, and start boat launch preparation. You put in the drain plug, take off your transom saver, pull of your safety straps, put in your boat lights, etc, etc. About 10 minutes later, your partner finally start backing you and the boat down the ramp. The sky is starting to light up from the early morning sun. The two trucks behind you start to honk their horns! You shout back, "You shoulda got here earlier!"

The boat is finally launched, you beach the boat and pick up your partner. The tournament director had already started to call the boats numbers out as many of them were already going down the lake. Your boat number had already been called, and there were about 20 other boats still waiting, so you quickly take off leaving a huge wake right in the middle of the waiting boats.

As you approach your fishing hole, you see another boat sitting right on your spot! The spot is a bulrush line which is loaded with bedding fish, but it's only about 30 yards long. You are real anxious so you don't get off plane until your right on the weedline. You quickly lower your trolling motor, pick up your bedding fish rig and start pitching the pockets and points along the bulrush patch. Your partner is doing the same thing, in fact he get's the 1st fish around 2 pounds and you tell him to swing it in like a "real" man.

The other boat doesn't have an anchor down nor has his trolling motor up so you edge to within 20 feet of his boat and as you do you get your 1st fish on. You yell at your partner to get the net and he quickly scoops up your nice 2 pound fish. You give him a high five for a nice netjob!

On the 1st pass, you noticed that the fish were getting spooked from their beds as you approached, so you decide to try to keep the boat outside of the weedline, with the nose of the boat pointing towards the weeds, and the back of the boat out in the main lake. You figure this tactic will keep 'em from spooking.

By about 10 AM, you have your limit and the tactic of keeping the back of the boat out of the weeds paid off. Your partner still only has one fish, but you think that he just doesn't know how to fish. He then asks you if he can share the front deck of the boat with you and you tell him no, there's no room and he'll mess up your hookset.

About noon, you've culled a few fish but can't seem to get a nice kicker fish. You see the other boat land a nice one, so you put your trolling motor on high and take the inside track in the bulrush patch right in front of the other boat. Your about 30 feet from the other boat, but buried up in the bulrush patch, scouting for bigger fish. You see a nice one about 4 pounds on a bed. The fish doen't seem to want anything as you toss just about everything in your tacklebox at it. Finally, you tie on a tube bait and "Wam" the 4 pounder hits, your partner quickly nets it and into the live well it goes.

You only have 30 minutes to go and to play it safe you decide to go. You fire up the big motor right in the middle of the weeds and take off, sending a nice wake into the other boat.

You get to the weighin with about 25 minutes left and beach it. You kick back waiting for the director while your partner takes off for the nearest restroom.

OK, so my story is a little extreme but lets look at the missing etiquette:

1- Always leave on time. Your partner won't worry and you'll get to the ramp and not hold up anyone.

2- Turn off your headlights while waiting in the launch line. Keep your parking lights on. This will prevent you from blinding the person that is backing the boat down the ramp!

3- Prepare for boat lauch long before you get to the front of the line. This will speed up the entire launch process for everyone.

4- Never plane right in the middle of a bunch of boats. You need to get beyond the last standing boat before you take off on plane.

5- Always give some room to another boat even if they don't have their trolling motor up/anchor down especially if they are there 1st. In the scenario above, you should only respectfully fish the furthest bulrush from the boat that is there or maybe not even fish there at all until he leaves. At least ask if he minds if you do decide to share the spot with him. If he says yes, you are way better off in the long run to leave. Your day will come!

6- Always net fish (if allowed by the tournament) and don't wait for the partner to ask you to get the net. If your partner prefers you not to net the fish, he'll tell you.

7- Always be considerate of your partners fishing position. In this scenarion, he didn't stand a chance because he was too far away to site fish! Offer him a chance at the front of the boat. In fact most tournaments (not the proams) state they have 50% share in running the trolling motor. At least ask, and if he refuses because he's not comfortable running it then fine.

8- Fish until the last possible minute with a slight safety factor unless you have a large limit of fish , especially if your draw partner isn't doing well. In this scenario, give you partner the full front of the boat and let him choose his spots.

9- Draw partners should only pay 50% of the fuel bill for both the tow vehicle and boat. If they drove to the ramp themselves, then they need only pay 50% of the boat fuel.
